Ex-boyfriend convicted of shooting and killing new boyfriend

An altercation between a 39-year-old man and his former girlfriend in New Orleans allegedly led to the death of her new boyfriend. The ex-boyfriend, from Metairie, Louisiana, was accused of a felony charge associated with the new boyfriend's death: second-degree murder. The man was found guilty and was recently sentenced to life in prison.

On April 10, 2010, the ex-boyfriend was at the same club as his ex-girlfriend. When he asked her to dance around 3 a.m., she turned him down. He reportedly struck her and stabbed her with his car keys after she said no. Hours later, prosecutors believe that the man went to her home. Police said that the man shot the new boyfriend, a 36-year-old man, at her residence.

The apartment's lock had been broken and nothing had been stolen when the victim's body was found more than 12 hours later. According to a witness who testified during the trial, the ex-boyfriend called and confessed. But it's important to note that there was no ballistic evidence linking the man to the murder.

Police used cellphone records to show that the man was in eastern New Orleans around the time of the man's death when he reportedly told police that he drove downtown after leaving the bar and then headed home to Metairie. Allegedly, he also shot himself in the leg and, around 7 a.m., he showed up at a hospital for treatment.

The jury eventually convicted the man of second-degree murder, even though two of its members found the man innocent. Louisiana is one of two states that allow for the conviction of a person charged with a felony even with two votes against conviction. Does this sound like he is guilty beyond a reasonable doubt?
